Set up panel to see if disabled students can study MBBS: Delhi High Court

The Delhi High Court Thursday ordered the setting up of another committee headed by AIIMS doctors and experts to examine if students with hearing impairment and dyslexia are eligible to pursue MBBS/BDS courses and determine the percentage of disability.

The order comes after two cases came up for hearing before two HC benches, one of a student with dyslexia and another student who is hearing impaired — who were denied admission to medical colleges.

In the first case, a bench of Justice S Ravindra Bhat and Justice A K Chawla directed the Centre and the Medical Council of India (MCI) to allow the student with dyslexia to participate in the admission counselling process to enroll for graduate medical courses.

“In the meanwhile, expert opinion from a team of doctors (comprising three senior members of the Psychiatry/Neurology department…, excluding the expert, who co-authored or was part of the committee which issued the report in the present case) may be constituted by Director, AIIMS, to examine the petitioner (Devrrat Purang),” said the bench.

Backing the direction of Justice Bhat and Justice Chawla, another bench headed by Justice Sanjiv Khanna said the experts shall furnish a report on the two aspects for the hearing-impaired student. The girl has got admission in a medical college, following orders issued by an HC single judge bench. The MCI challenged the decision.

Both benches sought expert opinion on “the extent of the disability with percentage, if any; if yes, if it is within the benchmark of the disabilities Act; and whether the petitioners, with the kind of disability he/she is suffering, is fit to undertake the MBBS course”.

Purang moved the court, alleging that his disability (dyslexia) has not resulted in palpable benefits — despite being classified by the Parliament in the Rights of Persons with Disabilities Act, 2016.

He complained that his candidature for a medical seat, under the 5% reservation for Persons with Disability (PwD), has not been accepted.

MCI counsel T Singhdev submitted to Justice Bhat and Justice Chawla that the relief sought is similar to what was asked before the Bombay High Court, which had rejected the claim on the ground that there is no method for quantifying the extent of learning disability.

However, he told the court that the apex court, in another matter, had taken a more nuanced approach in the context of another disability (low vision). “The apex court had ordered setting up of an expert committee to look into whether the petitioner… is fit to undertake the MBBS course,” Singhdev submitted.

The High Court ordered the same in these two cases and sought the expert opinion within a week.

A Year After Getting Their Medals, Indian Deaflympics Winners Are Still Waiting for Prize Money

“We keep going to offices of sports ministries, in Haryana and the central government, but nothing happens"

In 2017, four Indians won medals at the Deaflympics held in Turkey. All of them are from Haryana: Virender Singh won a gold medal in 74 kg Freestyle Wrestling while Ajay Kumar and Sumit Dahiya won bronze in 65 kg and 97 kg Freestyle Wrestling respectively. And Diksha Dagar won a silver medal in individual golf. All of them are still waiting to get the reward money promised to them for bringing sporting honour to the country.

In 2015, the Haryana government included Deaflympians in its sports policy. At the time, Singh—a seven-time medallist for India and an Arjuna Awardee—still hadn’t even been paid for a previous victory.

A year later, Haryana announced cash awards for Paralympians equivalent to Olympic prizes: Rs. 6 crore to gold medalists, Rs. 4 crore to silver medalists, and Rs. 2.5 crore to bronze medalists. A month before the 2017 Deaflympics, the Haryana government responded to an RTI filed by filmmaker Vivek Chowdhary, saying that it would pay Deaflympians equal money to Paralympians (and by extension, Olympians). But after the big wins—poof.

According to Singh, athletes didn’t even get “pocket allowance” while in Turkey. And when he raised a protest after his return, he was banned from wrestling by the All India Sports Council for the Deaf (AISCD).

“We keep going to offices of sports ministries, in Haryana and the central government, but nothing happens,” said Rambir Dagar, Virender’s friend, who helps him with navigating interviews and other processes.

When it comes to the central government, according to the Scheme of Special Awards to Medal Winners in International Sports Events, last amended in May 2018, Deaflympian medalists should receive Rs. 15, 10, and 5 lakh for Gold, Silver and Bronze medals. The Deaflympians allege that they haven’t received anything.

Earlier this year, the AISCD filed two complaints against the Sports Authority of India (SAI) and Ministry of Youth Affairs and Sports with the Court of Chief Commissioner For Persons with Disabilities, against the unfair treatment of Deaflympians. In both judgements, the SAI was “advised to [...] give due weightage to deaf sportspersons for providing the cash awards and the financial assistance to the Deaf sportspersons at par with the Para sportspersons”.

Under pressure, the Haryana government quietly forked out a random Rs. 1.2 crore to Virender Singh in May this year, and Rs. 42 lakh each to Kumar and Dahiya. Diksha Dagar is still to be paid.

The Deputy Secretary to Sports Minister Rajyavardhan Singh Rathore, Shiv Pratap Singh Tomar, told VICE that the Deaflympians should receive their money, but they have to file paperwork. According to Virender Singh, the paperwork has long been filed by the AISCD. VICE received no further comment from the AISCD’s office in response to questions sent over email.

Two More Deaf and Mute Girls Accuse Bhopal Hostel Director of Rape

Ashwini Sharma, director of a hostel for deaf and mute persons in Awadhpuri area here, was arrested on Wednesday based on the complaint by an inmate who alleged that the accused had raped her repeatedly during her stay at the hostel over the past three years.

10.08.2018,  Bhopal Two more deaf and mute tribal girls have filed a complaint against a city hostel director, who is currently under arrest in a rape case, for molesting them last year, police said on Friday.

Ashwini Sharma, director of a hostel for deaf and mute persons in Awadhpuri area here, was arrested on Wednesday based on the complaint by an inmate who alleged that the accused had raped her repeatedly during her stay at the hostel over the past three years.

She had filed a complaint on Wednesday after which Sharma was arrested under sections 376 (rape), 354 (outraging modesty), 344 (wrongful confinement) and 506 (criminal intimidation) of the IPC and relevant sections of the SC/ST (Prevention of Atrocities) Act.

Sharma was produced in court today and was remanded in police custody for two days. Two more girls filed a fresh case against the accused at the Hira Nagar police station in Ujjain district on Thursday, police said.

Hira Nagar Police Inspector Mahendra Singh Bhadoria today said two Dhar-based sisters lodged a complaint that Sharma had molested them. The case was then transferred to the Awadhpuri police station, he added.

Bhadoria said the incident happened when the sisters stayed at Sharma's house-cum-hostel last year while they were pursuing a course at Bhopal's Industrial Training Institute.

He added that since one of the complainants was a minor, when Sharma allegedly molested her in Bhopal in 2017, provisions of the Protection of Children from Sexual Offences (POSCO) Act were also invoked against the accused.

The Bhopal Police today formed a Special Investigation Team (SIT) to probe the case while the state government announced that a monthly inspection would be carried out at women's hostels in the state.

Inspector General of Police (Bhopal) Jaydeep Prasad told PTI that the SIT would comprise Rahul Lodha, Superintendent of Police, Bhopal City South, along with Additional SPs Rashmi Mishra and Dinesh Kaushal, City Superintendent of Police (CSP) Virendra Mishra and Awadhpuri Inspector ML Bhati.

Prasad said preliminary investigations had revealed that Sharma was a "lone wolf" in the case, adding that he had "personally inspected the hostel".

Meanwhile, Madhya Pradesh Chief Minister Shivraj Singh Chouhan issued directions to his officials to take steps to ensure that such incidents did not occur again.

"I have held a meeting with officials and directed them to conduct monthly inspections of such (state) aided and unaided facilities where girls are residing," he told reporters at his residence in this morning.

"The inspection will be carried out by the collector and the superintendent of police in each district on a monthly basis," he said.

Calling such incidents painful, Chouhan said similar rules would also be framed for private hostels.

Senior Congress leader Kamal Nath today shot off a letter to Chouhan seeking a probe into the incident by the Central Bureau of Investigation.

“ நிதிஷ் சார், உங்களுக்குப் பெண் குழந்தை இல்லையா?, பாதிக்கப்பட்டவர்களில் உங்களுடைய மகள் இருந்தால்கூட இப்படித்தான் மெத்தனமாக இருந்து தாமதமாக நடவடிக்கை எடுப்பீர்களா என்று பீகார் முதல்வர் நிதிஷ் குமாருக்கு டெல்லி மகளிர் ஆணையத்தின் தலைவர் ஸ்வாதி மாலிவால் கடிதத்தில் தெரிவித்துள்ளார்.

பிஹார் மாநிலம் முசாபர்பூர் மாவட்டத்தில், சேவாக் சங்கல்ப் இவான் விகாஷ் சமிதி சார்பில் பிரிஜேஷ் தாக்கூர் என்பவர் சிறுமிகளுக்கான காப்பகம் ஒன்றை நடத்தி வருகிறார்.

இந்தக் காப்பகத்தில் காது கேளாத, வாய்பேச முடியாத, மனநலம் பாதிக்கப்பட்ட 11 வயது முதல் 17 வயது வரையிலான சிறுமிகள் 40-க்கும் மேற்பட்டோர் தங்கி இருந்தனர். இவர்களுக்கு இரவு உணவில் மயக்க மருந்து கொடுத்து அந்தக் காப்பகம் நடத்துபவர்கள் பலாத்காரம் செய்து வந்தனர். சமீபத்தில் டாடா சமூக அறிவியல் நிறுவனம் இந்தக் காப்பகத்தில் ஆய்வு நடத்திய போது 15 சிறுமிகள் பலாத்காரம் செய்யப்பட்டது கண்டுபிடிக்கப்பட்டது.

அதன்பின் அங்கிருக்கும் 42 சிறுமிகளுக்கும் மருத்துவப் பரிசோதனை நடத்தப்பட்டது. அப்போது அங்கிருக்கும் 42 சிறுமிகளில் 34 சிறுமிகள் மாதக்கணக்கில் பாலியல் பலாத்காரத்துக்கு உட்படுத்தப்பட்டு இருப்பதும், பலருக்கு கருக்கலைப்பு செய்திருப்பதும் மருத்துவப் பரிசோதனை அறிக்கையில் தெரியவந்தது.

இதையடுத்து, போலீஸார் வழக்குப் பதிவு செய்து அந்தக் காப்பகத்தின் உரிமையாளர் பிரிஜேஷ் தாக்கூர் , ஊழியர்கள் 10 பேர் என மொத்தம் 11 பேரைக் கைது செய்தனர். இவர்கள் மீது கடந்த மாதம் 26-ம் தேதி குற்றப்பத்திரிகை தாக்கல் செய்யப்பட்டது. மேலும், இந்த வழக்கில் ஏராளமானோருக்குத் தொடர்பு இருப்பதால், இந்த வழக்கை சிபிஐ விசாரிக்கப் பரிந்துரை செய்து பிஹார் மாநில அரசு பரிந்துரை செய்துள்ளது.

இந்நிலையில் டெல்லி மகளிர் ஆணையத்தின் தலைவர் ஸ்வாதி மாலிவால் பீகார் முதல்வர் நிதிஷ் குமாருக்கு காட்டமாக கடிதம் எழுதி அதை வெளியிட்டுள்ளார். அதில் கூறப்பட்டு இருப்பதாவது:

நிதிஷ் குமார் சார், உங்களுக்குப் பெண் குழந்தை இல்லை. நான் உங்களிடம் ஒரு கேள்வி கேட்க விரும்புகிறேன். முசாபர்நகர் மாவட்ட காப்பகத்தில் 34 சிறுமிகள் பலாத்காரம் செய்யப்பட்ட விவகாரத்தில், நீங்கள் நடவடிக்கை எடுக்காமல் இருக்கிறீர்களே, அதில் உங்களின் மகளும் ஒருவராகப் பாதிக்கப்பட்டு இருந்தால் இப்படித்தான் இருப்பீர்களா.

உங்களின் இந்தச் செயல்பாட்டால் நாட்டில் உள்ள கோடிக்கணக்கான பெண்கள், சிறுமிகளின் மதிப்பை நீங்கள் இழந்துவிட்டீர்கள்.

இந்த காப்பகத்தில் தங்கிய அப்பாவி சிறுமிகள் பலாத்காரம் செய்யப்பட்ட விவகாரத்தில் என்ன நடவடிக்கையை பீகார் மாநில அரசு எடுத்துள்ளது. எங்களுடைய குழு, பாதிக்கப்பட்ட சிறுமிகளுக்கு ஆதரவாகப் பணியாற்ற தயாராக இருக்கிறது. தேசச்தில் உள்ள லட்சக்கணக்கான மக்கள் எங்களைப் போல் உதவி செய்ய காத்திருக்கிறார்கள்.

முசாபர்பூர் காப்பகத்துக்குச் சென்று தணிக்கை செய்த டாடா சமூக அறிவியல் நிறுவனம் கடந்த ஏப்ரல் மாதமே அறிக்கை அனுப்பிவிட்டது. ஆனால், பீகார் அரசு எந்தவிதமான நடவடிக்கையும் அந்தக் காப்பக உரிமையாளருக்கு எதிராக 3 மாதங்களாக எடுக்கவில்லை என்பது வேதனை அளிக்கிறது. அதற்குப் பதிலாக அந்தக் காப்பகத்தை நடத்திவரும் அரக்கன் பிரேஜேஸ் தாக்கூருக்கு அரசு சார்பில் ஏராளமான திட்டங்களை செயல்படுத்த அனுமதி அளிக்கப்பட்டுள்ளது.

இந்தச் சம்பவங்கள் குறித்து ஊடகங்கள் வெளிச்சத்துக்கு வந்தபின்பும், நீங்கள் கடுமையான நடவடிக்கை எடுத்துப் பார்க்கவில்லை. சூழலைப் பார்த்து சிபிஐக்கு வழக்கை மாற்றி உத்தரவிட்டுள்ளீர்கள். உங்களின் இந்த முடிவால்தான் பிரேஜேஸ் தாக்கூர் கைது செய்யப்பட்ட போதிலும் கூட அவர் முகத்தில் மிகப்பெரிய புன்னகையை நாங்கள் பார்க்கிறோம்.

அந்த சிறுமிகள் இன்னும் காப்பகத்தில் அடைபட்டுக் கிடக்க வேண்டுமா அல்லது அவர்கள் எதிர்காலத்துக்காக அரசு ஏதும் உதவி செய்யப்போகிறதா, அவர்களுக்காக நல்ல பள்ளிக்கூடம் ஏதும் தொடங்கப்பட்டு இருக்கிறதா அவர்களுக்கு மனரீதியாக கவுன்சிலிங் கொடுக்கப்பட்டதா

பிஹார் மாநிலம், முசாபர்பூர் மாவட்டத்தில் காப்பகம் ஒன்றில் 34 மாற்றுத்திறனாளி சிறுமிகள் பலாத்காரம் செய்யப்பட்ட வழக்கை தாமாக முன்வந்து விசாரணைக்கு எடுத்த உச்ச நீதிமன்றம், மத்திய அரசுக்கும் பிஹார் மாநில அரசுக்கும் விளக்கம் கேட்டு நோட்டீஸ் அனுப்பி உத்தரவிட்டுள்ளது.

அதுமட்டுமல்லாமல், பாதிக்கப்பட்ட அந்தச் சிறுமிகளின் புகைப்படம், பேட்டி உள்ளிட்ட எந்தவிதமான தகவலும் நாளேடுகளிலும், தொலைக்காட்சிகளிலும் வரக்கூடாது என்று உச்ச நீதிமன்றம் உத்தரவிட்டுள்ளது.

பிஹார் மாநிலம் முசாபர்நகர் மாவட்டத்தில், சேவாக் சங்கல்ப் இவான் விகாஷ் சமிதி சார்பில் சிறுமிகளுக்கான காப்பகம் ஒன்று செயல்பட்டு வருகிறது. இந்தக் காப்பகத்தில் காது கேளாத, வாய்பேச முடியாத, மனநலம் பாதிக்கப்பட்ட 11 வயது முதல் 17வயது வரையிலான சிறுமிகள் தங்கி இருக்கின்றனர். இவர்களுக்கு இரவு உணவில் மயக்க மருந்து கொடுத்து அந்தக் காப்பகம் நடத்துபவர்கள் பலாத்காரம் செய்துள்ளனர்.

இந்த விவகாரம் சமீபத்தில் வெளியாகி பெரும் அதிர்வலையை ஏற்படுத்தியது. அந்தக் காப்பகம் நடத்துவோரும், அங்கு பணியாற்றும் ஊழியர்களும் காப்பகத்தில் உள்ள 34 சிறுமிகளைப் பலாத்காரம் செய்துள்ளதாகவும் குற்றச்சாட்டு எழுந்தது. இது குறித்து போலீஸார் வழக்குப் பதிவு செய்து அந்தக் காப்பகத்தின் உரிமையாளர்கள், ஊழியர்களைக் கைது செய்து விசாரணை நடத்தி வருகின்றனர்.

இதற்கிடையே காப்பகத்தில் சிறுமிகள் பலாத்காரம் செய்யப்பட்டதைக் கண்டித்து ராஷ்ட்ரிய ஜனதா தளம், மார்க்சிஸ்ட் கம்யூனிஸ்ட் கட்சி சார்பில் இன்று பந்த்துக்கு அழைப்பு விடுத்திருந்தது.

இதற்கிடையே பிஹார் மாநிலத்தைச் சேர்ந்த ஒருவர் உச்ச நீதிமன்ற நீதிபதிக்கு எழுதியுள்ள கடிதத்தில் காப்பகத்தில் இருந்த 34 சிறுமிகள் பலாத்காரம் செய்யப்பட்ட விவகாரத்தை தாமாக முன்வந்து விசாரிக்க வேண்டும் எனக் கேட்டிருந்தார்.

Hearing impaired MBBS aspirant gets relief from Delhi High Court

The court also called recommendations of the Medical Counselling Committee (MCC) "abhorrent to the principles enshrined in the Constitution of India and to the provisions of Rights of Persons with Disabilities Act, 2016".
The Delhi High Court has come to the rescue of a student with a hearing impairment, and directed the Centre and the Medical Council of India (MCI) to allow her to participate in the admission counselling process to enroll for MBBS/BDS courses. The court also called recommendations of the Medical Counselling Committee (MCC) “abhorrent to the principles enshrined in the Constitution of India and to the provisions of Rights of Persons with Disabilities Act, 2016”.

The MCC was constituted by the MCI, following a directive by the Ministry of Health and Family Welfare, to specify provisions for students with disabilities eligible to enroll in MBBS/BDS courses. Among its recommendations, the MCC had said that those with more than 40% hearing disability cannot pursue graduate medical education. Once a student with disability cleared the National Eligibility Entrance Test (NEET), he or she had to appear before a medical board, which followed the MCC’s recommendations in granting eligibility certificate to students. The medical board is present in four hospitals—in Delhi, Kolkata, Mumbai and Chennai.

Dealing with the case of a minor with hearing impairment, Justice Siddharth Mridul observed that the Disabilities Act came into being to give effect to the UN Conventions on the Rights of Persons with Disabilities, to which India was a signatory. “The Preamble to the said Act does not permit for any deviation from the stated objective, namely, to accord respect for inherent dignity, individual autonomy, freedom of choice, right against non-discrimination, full and effective participation in society and equal opportunities in all walks of life… to persons who are differently abled,” Justice Mridul noted.

“In this view of the matter, I am of the considered view that prima facie, recommendations of the Committee set up by MCI… are abhorrent to the principles enshrined in the Constitution of India and to the provisions of the said Act,” the judge said.

The court directed authorities to allow her to participate in counselling for the MBBS course for the academic session 2018-2019 under the physically handicapped category. The girl had moved the court through her father, and had sought directions to the Centre and MCI to get her admitted into an MBBS course. She had secured 95.08 percentile score in NEET (UG) 2018, but was found to have hearing disability of 70%.
