PGI violating rights of disabled, group tells Nadda

In what has been termed as violation of the Rights of Persons with Disabilities (RPD) Act, 2016, by the PGI, “Doctors with Disabilities”, a social activist group of speciallyabled people, based in New Delhi, have written a letter to the union minister of health and family welfare, JP Nadda.

The group has alleged that non-dominant upper limb was included in reservation for admissions to postgraduate courses in medical colleges and institutions. But the PGI and JIPMER, Puducherry, were restricting these reservation benefits to candidates with disabilities directly violating Section 32 of the RPD Act.

“The union ministry of health and family welfare has recently amended guidelines of the MCI restricting candidates with certain disabilities.

“The Supreme Court as well as the high courts of various states granted relief to candidates with upper limb disability, lower limb disability more than 80%, hearing impairment, low vision, haematological disabilities, specific learning disabilities etc. to name a few,” said Dr Satendra Singh, founder of the social activist group.

Responding to the ‘violations’, Dr Rajesh Kumar, dean, academics, said: “The Postgraduate Institute of Medical Education and Research is a premier medical and research institution in Chandigarh is sensitive to such issues and if there are rules which include the upper limbs as well, we shall immediately correct our prospectus.”

He said: “I have asked the registrar to dig out rules which are applicable to the institutions of national importance as we are not under the Medical Council of India (MCI). Also, Section 21 of the RPD Act mandates appointment of a faculty with disability as grievance redressal officer.

“However, there is no such system either in the PGI, JIPMER or AIIMS, New Delhi. We shall abide by this Act and immediately work on it.”

A letter was written by the Medical Council of India (MCI) and the union ministry of health and family welfare to the health secretaries of all states/ UT to follow the Rights of Persons with Disabilities (RPD) Act, 2016, in letter and spirit.

This allowed candidates from 21 disabilities (without any mention of the upper or lower limb) to avail 5% reservation in higher education.

As I pushed and elbowed my way toward the cricket stadium in Gurgaon, slowly interpreting the ear-splitting commentary booming out of the loudspeakers, I took a deep breath.

In front of me, as I envisaged, was a larger-than-life cricket match happening between India and Sri Lanka. The final tournament of the Deaf ICC T20 world cup was spell-binding, but intrinsically different. It was for the first time that India organized this tournament, including teams from Nepal, Sri Lanka, Australia, South Africa.

As a cricket fanatic who watches matches with bated breath and nail-biting suspense, I slowly scrutinized the entire spectacle. From far, it looked as a normal tournament, with two teams competing against each other while others sat facing toward the pitch, wearing their respective country’s flannels, completely transfixed with the game.

The only, perhaps the most fundamental anomaly, here was the lack of sound.

The entire experience was categorically different, especially because the way we participated in it was completely in contrast with how the players did. Yet, the spirit of sportsmanship galvanized across these impediments, transforming the initially passive match into a scathing competitive one.

Deaf cricket is different at several stages. To start with, each country has its own sign language, which is at times, different from the international sign language. Every team hence has an interpreter to communicate gestures, body language inputs, reactions, reflexes and opinions.

Though, few players, especially those from Australia, South Africa wear Cochlear implants, they cannot wear them while playing in the field. The implants cause a sensory overload, heightening the decibels, eventually jamming the sound inputs for the players.

Stefan Pichowski, the British chairperson of Deaf ICC, explained the process. Now 38-years-old, Stefan had an implant three years back. Though he always represented England’s deaf cricket team, his life did change when he heard sound for the first time.

“Visuals play an important role in deaf cricket. It is all about non-verbal communication. At times, yes the deaf cricketers do not get the same information as their hearing inputs are restricted,” he said. Today Stefan can easily communicate, laugh and integrate with the audience.

Tough, the idea of deaf cricket is still in its nascent phase in India, the international deaf players exude the enigmatic spirit of utter confidence. A lot also differs on the kind of coaching, funding and support these teams receive in their home country. For example, Melbourne cricket club is one of the oldest sporting club for the deaf cricketers. Thereby, the finesse, excellence and reflex actions of the Australian cricketers are comparatively better.

Not an impediment

Australian cricketer David Melling who scored 112 for 63 balls against Nepal, confidently projects that hearing loss isn’t an impediment in cricket. ‘I aim to join the international team’, he says, beaming with hope. The very intrinsic idea that deafness is a hindrance, a liability does not exist in the vocabulary of players like him.

Even Brett Lee, the Australian cricket legend, who was the Chief Guest of honor in the finals, stated that awareness about hearing loss is very important. Linking his injuries, surgeries and challenges in his cricket career, Brett had inspired the players to rise above it. Since 2015, Brett Lee has been working tirelessly to promote hearing health.

But perhaps, the journey of deaf cricket in India along with the needed awareness is still a far-fetched idea. When compared to his Indian counterparts, the story unfolds in a different way. Sumit Jain, the General-Secretary of Deaf Cricket Society in India, states ‘I couldn’t hear since childhood but loved playing cricket. So, along with my friends, I established the deaf cricket society in 2012. The journey has been tough, especially due to the political hurdles but now we have grown from state-level to international level.

Unfortunately, Board Control for cricket in India (BCCI) does not fund and support the deaf team. ‘The annual investment in international cricket is Rs 8000 crore, but yet we are not funded,’ he reflects.

Nevertheless, away from the ruthless obstacles and political hurdles, the entire game of deaf cricket is an enjoyable experience. The concrete manner in which the players take wickets, score sixes and interpret the opposing team’s intentions is spell-binding. As the commentary continues and everyone remains enamored by the sport, the absence of sound does not necessarily emerge up.

ரயில் பயணத்தில் மாற்றுத்திறனாளிகள் சந்திக்கும் பல்வேறு கோரிக்கைகளை தீர்க்க வலியுறுத்தி மத்திய ரயில்வே அமைச்சர் இடம் நேரில் வலியுறுத்தி 9 மாதமாகியும், எந்த நடவடிக்கையும் எடுக்காத்தால் நாடு முழுவதும் ரயில்வே கோட்ட அலுவலகங்கள் முன் போராட்டங்கள் நடத்திட ஊனமுற்றோர் உரிமைகளுக்கான தேசிய மேடை அறைகூவல் விடுத்திருந்தது.

அதன்படி டிச-11 அன்று தமிழ்நாடு அனைத்து வகை மாற்றுத்திறனாளிகள் மற்றும் பாதுகாப்போர் உரிமைகளுக்கான சங்கம் சார்பில் சென்னை, திருச்சி, மதுரை, சேலம் ஆகிய கோட்ட அலுவலகங்களின் முன்பு எழுச்சிமிக்க போராட்டங்களை மாற்றுத்திறனாளிகள் நடத்தினர்.

அப்போது, ஊனமுற்றோர் உரிமைகள் சட்டப்படி அரசு தரும் ஒரே அடையாள சான்றையே நாடு முழுவதும் எல்லாத்துறைகளும் ஏற்க வேண்டும், ரயில்வே நிர்வாகம் தரும் தனியான சான்றை வாங்கச் சொல்லி அலைக்கழிப்பதை நிறுத்த வேண்டும், முதியோர் ரயிலில் பயணம் செய்யும்போது மட்டும் பரிசோதகரிடம் சலுகைக்கான அடையாள சான்றை காண்பிக்கும் வசதி உள்ளது போன்று, மாற்றுத்திறனாளிகளுக்கும் வசதி செய்ய வேண்டும், இதன் மூலம் பயணச்சீட்டு வழங்கும் மைய ஊழியர்களால் அலைக்கழிப்பு செய்வது தடுக்க வேண்டும்.

PUDUKKOTTAI: When Cyclone Gaja roared into Pudukkottai town felling trees and blowing away roofs, on Gandhi Street, the six siblings of R Dhanalakshmi (26) did not realise they were in the midst of a severe disaster until their hut was damaged. This was because in Dhanalakshmi’s family, besides herself and her parents, other members are hearing- and speech-impaired.

The family from the Dalit (Arunthathiyar) community is presently staying in a rundown hut covered with tarpaulin and flex banners. Recounting the night, Dhanalakshmi said, “It was sudden and we were all fast asleep. We heard the sound of things falling and people calling out others to safety. But in the middle of all this was our hut, where six of my siblings were sleeping oblivious to what was happening.” Her mother Vasantha (60) said Dhanalakshmi and herself had a tough time waking up the siblings. In the darkness nothing could be communicated and the members only realised the scale of the disaster after they emerged from their hut.

They moved to their neighbour’s place and stayed there until the storm subsided. When they returned to check on their hut, the roof was damaged, one side was completely exposed to the elements and the hut was barely standing. “Everything was wet, table fans and TV were damaged. Those were the only appliances we had,” said Dhanalakshmi.

The days without power after the cyclone were another test of their resolve. They stayed in the home of a distant relative, who is also a neighbour. The family is sceptical whether they could ever recover. Dhanalakshmi and her disabled sister Saraswathi (30) are the breadwinners, together earning around `4,000 a month working as domestic helps. Four siblings receive monthly financial grant from the government meant for disabled.

Apart from being hearing- and speech-impaired, one of the brothers, Murugesan (35) is visually-impaired and the other, Karthik (27) had undergone a kidney operation which left him unfit for strenuous physical work. Other than Dhanalakshmi, who had studied till Class XII, none of the family members had much education. Their father Raju used to be a cobbler but spinal surgery done 25 years ago heavily restricted his mobility, forcing him to stay at home.

“Two of our sisters are married but they were abandoned by their husbands,” Dhanalakshmi said. Vasantha said, “I can’t even marry off my youngest daughter (Dhanalakshmi).She wants to stay home and tend to me, her father and siblings. It pains me that we are standing in the way of our daughter’s life.”

Dhanalakshmi said, “We could not go and collect relief material distributed by volunteers and have not received any help from the government yet.”The family said they see no light at the end of the tunnel and the best they can hope is just to survive.
