31.07.2015, KRISHNAGIRI: The Madras high court on Monday stayed the hearing of the hearing impaired minor girl's gang rape case stating that the case needs to be reinvestigated. The court chided the police officials after the petitioner's counsel K C Karl Marx pointed out several lapses in the chargesheet, which would help the accused to escape.
S Namburajan, state secretary of TARATDAC (Tamil Nadu Association for the Rights of All Types of Differently-abled and Care-givers) claimed that a gang of four raped a 16-year-old hearing impaired girl, of Kodaikkarai near Anchetty in Denkanikottai taluk in Krishnagiri on December 25, 2014.
Her parents approached the Anchetty police to lodge a complaint; the officials initially refused to accept the complaint, but registered it two days later. The parents alleged that instead of registering the case, the police wanted to conduct a kangaroo court outside the police station.
On February 13, member of CPM polit bureau, Brinda Karat wrote a letter to the Tamil Nadu DGP Ashok Kumar demanding action against police officials and doctors who were trying to get the case dropped and support the accused.
In the letter, Karat pointed out that the medical investigation report done at the Dharmapuri Government Hospital clearly stated that the victim's hymen was not intact.
"Hosur taluk Government Hospital doctor Nandhini, gave a false report which stated that the 'hymen was intact'. So necessary action needs to be taken against the Denkanikottai AWPS inspector Jayam, doctor Nandhini and police officials supporting the rape accused," she stated in the letter.
Meanwhile, TARATDAC, an NGO, demanded the Tamil Nadu Home Secretary to look into the case.
When contacted by TOI, Namburajan said that the Justice P N Prakash clearly stated in his order that the local police's chargesheet had many lapses. "These lapses would help the accused to get out of the case. So the judge ordered the local police to stay away from further investigations and we hope that the court would order a CBI or CB-CID inquiry into the issue," he said.
