INDORE: The Indore bench of Madhya Pradesh high court on Wednesday said a public interest litigation seeking the court's intervention to find deaf and mute Geeta's parents was not maintainable. The aggrieved persons may individually move the courts with their grievances, it said.
The petition was disposed by the division bench of Justice PK Jaiswal and Justice RK Dubey who accepted the state's contention that the matter concerning finding Geeta's guardians or parents cannot be decided in a PIL. However, a detailed order of the petition is yet to be released.
The petition had been filed by RTI activist Jitendra Yadav through advocate Kashu Mahant, seeking to expedite finding Geeta's parents by processing all applications for DNA tests at the earliest.
The petition had also alleged that the state and central government were not taking serious steps towards it and sought the high court's involvement in finding her parents.
The maintainability of the petition was argued by the state and the Centre who said that they were processing the applications and taking steps to find her guardians or relatives. During the hearing into the matter on Wednesday, advocate Rashmi Pandit represented the court and deputy advocate general Pushyamitra Bhargav appeared on behalf of the state.
In the public interest litigation which was filed in February 2017, the ministry of external affairs, state government, police, and administrative officials were made respondents along with the deaf and mute institute in Indore, who are taking care of Geeta. The girl had been stranded in Pakistan for 13 years before she was brought back to Indore.
Geeta is currently staying at an institute for the deaf and mute being run by Anand Service Society in Indore.
