AHMEDABAD: A sessions courton Thursday denied bail to the employee of a women shelter home - Paldi Vikas Gruh, Amrut Patel who was arrested on charges of raping and impregnating a deaf-mute inmate, who was mentally challenged also.
This incident surfaced in July-August after the 32-year old rape survivor was found five-month pregnant in the shelter home. Patel had sought bail on the ground that there was a consent on part of the woman. The public prosecutor Sudhir Brahmbhatt, on the other hand, relied on the
FSL report that revealed that DNA test established that Patel has fathered the child.
The court, too, observed that the issue of consent from the victim is a subject matter of the trial. But the victim was in custody of the shelter home, where the accused was working. Looking at the condition of the woman that she is deaf, mute and psychologically disturbed, she falls in the most unprivileged class and at this juncture there is no question of her consent. He has shamed the institution also. If the accused is granted bail at this stage, the victim and the institution will lose faith in law.
Earlier, the management of Vikas Gruh approached Gujarat high court to seek permission to terminate pregnancy of the rape survivor. But when the high court called the woman and asked her about her wish, she informed the court that she did not want abortion.
